Terms of sale
These Terms of sale govern the entire relationship between the company FyremCo LLC, publisher of the website MYFIT7.COM, located at 2201 MENAUL BLVD NE STE A, Albuquerque, NM 87107, (hereinafter referred to as « MYFIT7 ») and the Customer (hereinafter referred to as the « Customer ») who accepts them without reservation. These Terms of sale shall prevail over any other terms and conditions contained in any other document unless expressly agreed otherwise in writing by MYFIT7.
ARTICLE 1 – ACCEPTANCE OF TERMS OF SALE
The Customer acknowledges having read and accepted these Terms of Sale (hereinafter referred to as « TOS ») prior to placing any order. Therefore, any order and payment on the website of MYFIT7 “www.myfit7.com” (hereinafter referred to as the « Site ») signifies the Customer’s express acceptance of these TOS.
MYFIT7 reserves the right to adapt or modify these TOS at any time. Any new TOS will be brought to the attention of the Customer by being posted online and will be applicable only to sales made after this posting.
ARTICLE 2 – PRODUCTS
The MYFIT7 program includes a personalized sports training plan and a custom dietary program, designed by a fitness coach and a sports nutrition expert based on the customer’s individual characteristics and physical goals.
The MYFIT7 program also provides access to regular follow-ups with a fitness coach, available 7 days a week via messaging. The customer’s fitness and dietary programs are adjusted throughout the program based on their progress to optimize physical results.
As part of the custom dietary program design, MYFIT7 also prepares the customer’s shopping lists to facilitate their daily organization. MYFIT7 does not deliver food products.
MYFIT7 may also market various sports products outside of the MYFIT7 program framework.
MYFIT7’s offerings are sold online, on the site operated by MYFIT7, and are intended for both individual consumers and businesses.
The aforementioned TOS applies to all products and services described above.
MYFIT7’s offerings are available only to Customers (who must be of legal age to place and pay for an order) for their personal consumption. Reselling products marketed by MYFIT7 is strictly prohibited.
ARTICLE 3 – ORDER AND PAYMENT
Customers can place orders on the MYFIT7 website. Customers must select the products and services and confirm the order using the payment methods offered by MYFIT7. Payments made by credit card will be processed through a reliable and secure system. The amount due for payment equals the total order amount minus any discounts granted by MYFIT7 during the order by entering one or more promotional code(s).
The terms for using discounts are defined in Article 11 of these terms. Some products may not be on promotion, and their purchase can be restricted by MYFIT7.
Customers have the option to create an account, choosing a username and password that must be kept strictly confidential. To place an order, customers must provide their first name, last name, a precise delivery address, and an operational phone number to ensure the delivery provider can deliver the order efficiently. In this regard, customers commit to providing honest, accurate, and up-to-date information at the time of the order.
MYFIT7 reserves the right to decline an order, particularly in the event of any unforeseen circumstances. In such a case, the customer will not be charged any fees. If applicable, MYFIT7 will inform the customer by any means.
ARTICLE 4 – PAYMENT BY INSTALLMENT
When processing their order, the customer has the option to pay for their order in multiple installments without any fees. Payment by installments is provided as a payment convenience and does not exempt the customer from paying the full amount of their order.
ARTICLE 5 – SPECIAL TERMS OF SALE
The Customer acknowledges having been informed, at the time of placing their order, of the terms of sale as displayed on the Site, including the price and description of the products (though not exhaustively), and expressly agrees to accept them without reservation. The placement and confirmation of the order by the Customer signifies their full and complete acceptance of the terms of sale. The Customer commits to a reasonable use of the service.
ARTICLE 6 – DELIVERY
In the case of orders for physical products, products will be delivered to the address provided by the customer at the time of the order. The current average delivery time is 3 working days.
ARTICLE 7 – PROMOTIONS
The order amount may potentially be reduced by a promotion; this is realized by providing the customer with a discount code through any means that MYFIT7 deems appropriate to enter during the order process.
Only one promotion can be applied per order; promotions are not stackable.
ARTICLE 8 – DURATION OF THE COACHING
The MyFit7 program and personalized coaching last for 4 months. During these 4 months, the client receives tailored coaching from their coach, available 7 days a week via messaging. After these 4 months, the client retains access to all the programs they have completed.
The start date of the 4-month sports and nutrition program is set for the Monday following the client’s order or on a later date at the client’s specific request.
If the client wishes, they can opt to start a new 4-month coaching session. To do this, they should contact MyFit7 or their coach directly.
ARTICLE 9 – REFUND POLICY
The client can obtain a full refund of their order if they request it before their coach has added their sports and nutrition programs to the schedule in their dedicated space on their app. Alternatively, the client is eligible for a full refund if they request it within 7 days of placing their order.
The client can also receive a full refund for their program if they see no physical progress after completing the program in full. A refund request for this reason must be made within 30 days from the end of the program to be considered valid.
The program is considered to be fully completed by the client only if they have completed each sports session and consumed each meal as planned in their program, have confirmed each of their sports sessions and each of their meals in the app (validation in the app must be done throughout the program), and have provided their coach with their updated weight along with a front and profile photo every week (allowing the coach to adjust the program based on the client’s progress).
ARTICLE 10 – CLAIMS
Any inquiries or complaints must be made by email, to the address contact@myfit7.com.
ARTICLE 11 – APPLICABLE LAW – DISPUTE RESOLUTION
The present TOS (Terms of Sale) are governed by the laws of the United States. In the event of a dispute, the Customer shall first approach MYFIT7 to seek an amicable resolution. If no resolution is reached, jurisdiction is granted to the competent courts of Albuquerque, New Mexico.
ARTICLE 12 – NULLITY
The nullity of a contractual clause of these terms does not result in the nullity of the entire terms, with the non-voided clauses retaining their full effect. The temporary non-application of one or more clauses of these terms by MYFIT7 shall not be deemed a waiver of such clauses by it.
